R. v. Soares
Careless Driving carries with it the potential for very serious penalties. The defendant in this case was charged as a result of his erratic driving that was observed firsthand by a police officer. The defendant did not give evidence at his trial. The prosecutor’s case appeared overwhelming at first but an effective cross examination of the investigating officer caused his evidence to be viewed in a different light at the conclusion of the trial. The defendant was acquitted.
